The agreement dated as of ___________________ is between _____________________________ (Buyer) and ________________________________________ (Seller). This agreement is in reference to the above mentioned puppy.
The Breeder and Buyer agree to the following:
Purchase Price/Deposit
A $500.00 non-refundable deposit shall be due upon the execution of this contract at time of being added to the waitlist. Exception of refundability is if the seller does not have a puppy available in the litter or a new litter expected within the time frame of six months. In this case the buyer may opt to have their deposit refunded. The price for a puppy for a pet home (limited AKC registration) is $2500.00. Dog’s will only be sold to approved breeders with Full AKC registration for an additional $1000.00. The remaining balance after the deposit is made will be due at time of pick up at 8 weeks of age. Payments may be made via cash or online on our website.

Limited Registration
Buyer is purchasing the puppy as a pet and companion and agrees to not use the dog for breeding purposes. Buyer agrees to spay/neuter their puppy between 18-24 months old. Buyer agrees to send proof of spay/neuter within one month of the procedure. Buyer agrees to responsibly prevent breeding of the puppy before the time of spay/neuter.
Full Registration
Buyer is an approved breeder, has completed interview, and agrees to pay an additional fee for Full Registration that allows breeding and show rights.
Proper Care
Buyer agrees to provide proper nutrition, shelter, and exercise for the puppy for the course of its lifetime. Also, the buyer agrees to provide adequate veterinary care and vaccinations recommended by the buyer’s veterinarian.
Restrictions on Resale or Rehoming
The buyer agrees to not resale the puppy for wholesale or to a pet store. In such a case that the buyer can no longer care for their puppy the buyer agrees to give the seller first right of refusal on the puppy. The buyer also agrees to not rehome the puppy without the seller’s consent. In such a case the buyer agrees to notify the seller so the seller can help find an adequate home for the puppy.
Health Guarantee
1-Year Hip, Elbow, Heart, DM and Von Willebrands Guarantee :
Because canine hip/elbow dysplasia, heart, eye, and so many other preventable illnesses are related to poor nutrition. We require that your precious puppy continue on a balanced fresh or raw food diet or at least a partial fresh/raw food diet for the first 12 months of his/her life in order to qualify for this 1-Year Health Guarantee. Our puppy guarantees become void if your puppy is not kept on one of the aforementioned food options for the first 12 months of his/her life. Remember, an ounce of prevention is worth a pound of cure! We highly recommend you continue to keep your pet on these foods beyond the guarantee period to promote optimal health for a lifetime. The following applies: the puppy must have an x-ray by your veterinarian to confirm the diagnosis and it must be documented by an official OFA preliminary consultation for hip/elbow diagnosis of moderate or severe dysplasia. The puppy must have a canine cardiologist perform an echogram to confirm the diagnosis of a severe heart murmur of either 5/6 or 6/6.
If our vet confirms a diagnosis of any of these Timeless Cottage Homestead will offer a monetary refund of up to 100% the price of the dog minus the deposit to cover vet expenses with proof of receipts from your veterinarian.
The following will void all guarantees:
- Allowing your puppy to become obese or underfed at any time.
-- Underfed: ribs are highly visible. Ideal body condition: can feel and see outline of ribs.
-- Obese: has no waist when viewed from above; belly is rounded when viewed from side.
- Evidence of neglect or abuse.
- Previous related trauma (broken bones, related injuries, hit by a car, etc.).
- Dog has been bred either purposefully or accidentally.
- Evidence of strenuous exercise. For example: no treadmill, no jogging, no extensive standing on back of legs, no excessive retrieving or playing on slippery floors.
- No accidents, negligence, or poisonings.
- Spayed/Neutered before 18 months of age.
- This guarantee is non-transferrable; puppy must be owned by the original owner named in the puppy agreement.
Refund Policy
If, within 72 hours of receiving your puppy, he/she is examined by a reputable veterinarian and the health of the puppy is found to be at serious risk due to a congenital defect (existing at birth), we require you to notify us and provide a written statement from a licensed veterinarian describing your puppy’s condition. The puppy must be examined by a licensed vet with 72 hours after receiving the puppy in order for this guarantee to be valid. In this unlikely event, you may return your puppy and papers to us within one week of the examination. This does not include worms, fleas, mites, coccidiosis, giardia, or any other parasites, as they are common in dogs and puppies. Timeless Cottage Homestead assumes no responsibility for veterinarian or shipping fees, nor are we responsible if your puppy contracts a communicable disease after leaving our possession.
In the event the puppy is diagnosed with parvovirus within the 72 hours and it is clear that it was exposed to it while in our care we will pay up to 50% of the price of the puppy to cover vet fees with proof after provided documentation and receipts from your vet. In the event the puppy does not survive a replacement puppy will be provided.
After the 72 hours up to 1 year of age, if your puppy is deemed to have a serious health risk:
Upon receipt of a letter to us from a reputable veterinarian stating that in his/her opinion this condition is congenital, your puppy will be replaced by a puppy of equal value at our availability/ability, or we will refund 50% of the puppy purchase price. We reserve the right to have a second opinion from our veterinarian. We also reserve the right to acquire DNA to determine the dog or puppy as one of our lineages, at our expense.
Should a dog purchased under this agreement be returned or exchanged for any reason whatsoever, the buyer/owner is responsible for all transportation expenses, veterinarian charges, crate fees, airfreight charges, and transport fees to and from the involved airports.
- we retain the right, at our sole discretion, to cancel our contract with you at any time and for any reason prior to the puppy reaching 8 weeks of age. If we opt to cancel our contract with you, we will refund your entire deposit within one week of cancellation.
- we make no guarantee regarding the loss of a puppy due to accidental death, theft, sickness due to lack of vaccinations, etc, or any other loss beyond our control, except as stated above.
- we have the right, at any time, to discontinue breeding Bernese Mountain Dogs and this contract will be void if we discontinue our breeding program.
To ensure immunity against diseases, please do not take the puppy into public places unless absolutely necessary until the puppy has had all its vaccinations (as recommended by your veterinarian). Buyer understands that care needs to be taken to protect the puppy’s developing hips and joints until they are fully developed until the age of two by limiting allowing the puppy to run on hard surfaces, jumping from high places, and pulling on the puppy’s legs. The Sellers will NOT be responsible for factors beyond their control, including, but not limited to: Negligence, cruelty, accidental injury, exposure to disease carrying animals, stress resulting from change in diet or environment, hypoglycemia, kennel cough, retained baby teeth, umbilical hernias, undescended testicles, inguinal hernia, or any other expense except as otherwise provided by law or in this agreement. This guarantee is only for the original purchaser of the puppy.
